Traditional Midwifery is Protected Under the First AmendmentĀ
Why Traditional Midwifery is Vulnerable to Chronic Persecution, even though it has been Long Sanctioned Under Basic American FreedomsĀ
The one thing that differentiates Traditional Midwifery from any other kind of Modern Midwifery that are regulated through various Federal as well as State Laws and legal obligations, is this: Traditional Midwifery is inherently grounded in Spiritual/Religious Cultural Identity and Tradition.
The First Amendment of the United States Constitution:
AMENDMENT I
"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
Traditional Midwives around the world are predominantly trained through mentorship with senior midwives and self-teaching. They choose to continue this way of life, even after centuries of severe persecution, for one major reason only:Ā
Traditional Midwifery is rooted in the foundational belief, that childbirth, motherhood, and family, are inherently Spiritual, not medical in nature. Traditional Midwifery is, and has been for thousands of years, inextricably tied to Spiritual/Religious structures and beliefs.
Traditional Midwives do not consider pregnancy and childbirth to be "medical conditions." Pregnancy and childbirth are a fundamental part of human life, and Nature Itself has an inherent Wisdom, Authority, and yes, Godliness in this matter.
As Traditional Midwives, and the mothers choosing our care, we have the inherent Constitutional Freedom to practice, and receive Traditional Midwifery Care.
Of course, this clashes severely, as always to Federal Tax Laws. A Traditional Midwife deserves to receive a living wage for her work, and I am not suggesting that she is automatically now "Tax Exempt," like a Church. However, the Federal Government and the "Powers that Be," tend to extort the ignorance of the easily intimidated everyday person, and create an intimidating illusion that Federal Law is a solid, stone statue that never changes. That never has to readdress important matters (such as the Ancient Practice of Traditional Midwifery). When, contrary to systemic everyday belief, the Federal Government is constantly having to readdress laws, and various issues that crop up on every layer of Government, and Law; and most importantly, rethink, and reassess these issues' relationship to the bedrock of our American Freedoms and Laws: The US Constitution.
The severe persecution of Traditional Midwives continues unbroken in the West, since at least the 15th Century. I have seen Traditional Midwives, who became the Pillars of their respective communities, cut-down by legal attacks and severe thrashings, that are too often supported by middle/upper-class hysteria; due to predominantly Medical, White, Western Male (and now Female), propaganda, that has also gone on, unbroken since at least the eighteenth century; against the long-standing, and Sacred Practice of Traditional Midwifery.
This is my "redress of grievances," exercised through Constitutional Free Speech. The Bill of Rights also protects citizens from undue, excessive punishment and cruelty. Totally legitimate, and Expert Traditional Midwives in America have gone and chained themselves to red tape, simply because they fear the hysteria that threw their fellow Traditional Midwives headlong into the social flames of a pyre, built by her persecutors, and supported predominantly, by social, widespread hysteria. This kind of pattern, inflicted over and over again, is absolutely, excessive and cruel, and therefore Unconstitutional; and therefore, as I am a Traditional Midwife, inherently governed by Higher Law, I proclaim it also, an Attack on the Human Spirit, and therefore immoral.
Traditional Midwives are therefore the only Professional Women, and indeed people in a society who can powerfully and effectively protect the Basic Human and Civil Rights of All People! We protect Human Life (All People) from its Inception and Women, through both Moral and Civil Law. It is therefore only rational, and self-evident that The First Amendment is our Core Legal Platform and Pivot Point; as The First Amendment unapologetically proclaims the Legal Freedoms of both Civil and Moral Matters.
I think we are beginning to see why the persecution of Traditional Midwifery has been so long-standing: The Traditional Midwife, since Ancient Times, is extremely Spiritually powerful, and not technically ever under ANY absolute jurisdiction or control.
A person such as this, has never been easily tolerated by "The Powers that Be," both secular and religious. Indeed, A Person such as this, is often easily, and severely subject to persecution, from both secular and religious factions.
